Biden Announces Vaccine Mandate Rules
Even though 70% of American adults are fully vaccinated and 80% are partially vaxxed I guess we are moving forward with the national mandate(kinda). The Department of Labor laid out the rules for the Biden Administration’s vaccine mandate that was announced back in September…(OSHA)
Under this policy employers with 100 or more employees must develop, implement and enforce a mandatory COVID-19 vaccination policy. Which must include…
- Determining the vaccination status of each employee, obtaining acceptable proof of vaccination status, and maintaining records and a roster of each employee’s vaccination status.
- A requirement that employees provide prompt notice when they test positive for COVID-19 or receive a COVID-19 diagnosis. Employers must then remove the employee from the workplace until they meet required criteria.
- Ensure each worker who is not fully vaccinated is tested at least weekly
- Require that employees who have not been fully vaccinated wear a face covering when indoors or when occupying a vehicle with another person for work purposes.
NOTE: Employers must develop, implement and enforce a mandatory COVID-19 vaccination policy OR they have to set a policy requiring employees to undergo regular COVID-19 testing and wear a face covering at work.
The policy goes into effect January 4th, 2022
Many have pointed out it’s not a full mandate in that if you don’t want to get vaccinated you have to wear a mask and get tested weekly. Is that still a vaccine mandate? Not technically, but even if it’s not vaccine mandates it’s still a mandate. Whether or not the President has the power to do that is an important constitutional question that may be answered when lawsuits inevitably get filed.
